وحكومة اليابان لتعديل الخطابات المتبادلة الموقعة بين الحكومتين

«إنشاء العيادات الخارجية لمستشفي الأطفال التخصصي التابع لجامعة القاهرة»

بعد الاطلاع علي نص المـادة (151) من الدستور ؛

وبعد موافقة مجلس الوزراء ؛

قــــــــرر :

(مادة وحــيدة)

وُوفق علي الخطابات المتبادلة بين حكومة جمهورية مصر العربية وحكومة اليابان لتعديل الخطابات المتبادلة الموقعة بين الحكومتين بتاريخ 2015/12/14 والمعدلة بتاريخ 2019/6/16 بشأن التعاون الاقتصادي الياباني المقـدم بهدف المساهمة في تنفيذ مشروع «إنشاء العيادات الخارجية لمستشفي الأطفال التخصصي التـابع لجـامعة القــاهرة» ، الموقعة في القاهرة بتاريخ 2021/8/3، وذلك مع التحفظ بشرط التصديق .

صدر برئاسة الجمهورية في 21 ربيع الأول سنة 1443هـ

(الموافق 28 أكتوبر سنة 2021م ).

وافق مجلس النـواب علي هذا القرار بجلسته المعقودة في 25 ربيع الآخر سنة 1443 هـ

(الموافق 30 نوفمبر سنة 2021 م ).

Excellency,

I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

"With reference to the Exchange of Notes dated December 14,. 2015 and amended on June 16, 2019 concerning Japanese economic cooperation extended for the purpose of contributing to the implementation of the Project for Construction of Outpatient Facility at Cairo University Specialized Pediatric Hospital, I have the honour to confirm on behalf of the Government of the Arab Republic of Egypt the following understanding recently reached between the representatives of the Government of the Arab Republic of Egypt and of the Government of Japan:

Sub-paragraph (1) of paragraph 1 of the said Exchange of Notes shall be amended as follows:

The term "one billion nine hundred and eighty-three million Japanese Yen (14,983,000,000)" is deleted and replaced by the term "two billion one hundred and eight million Japanese Yen (24,108,000,000)".

I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of Japan the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of receipt by the

Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.

This Note is written in the Arabic, Japanese and English languages, each text being equally authentic, and in case of any divergence in interpretation, the English text shall prevail".

I have further the honour to confirm on behalf of the Government of Japan the foregoing understanding and to agree that Your Excellency's Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.

This Note is written in the Japanese, Arabic and English languages, each text being equally authentic, and in case of any divergence in interpretation, the English text shall prevail.

I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

أتشرف بالإحاطة بأنني قد تلقيت خـطــاب سـعــادتكم المــؤرخ اليوم والــذي ينــص عـلي مـا يـلي :

"بالإشارة إلي الخطابات المتبادلة المؤرخة في 14 ديسمبر 2015 والمعدلة بتاريخ 16 يونيو 2019 بشأن التعاون الاقتصادي الياباني المقدم بهدف المساهمة في تنفيذ مشروع "إنشاء العيادات الخارجية لمستشفي الأطفال التخصصي التابعة لجامعة القاهرة"، أتشرف بأن أؤكد - نيابة عن حكومة جمهورية مصر العربية - علي التفاهم التالي الذي تم التوصل إليه مؤخرًا بين ممثلي حكومة جمهورية مصر العربية وحكومة اليابان :

سيتم تعـديل الفقــرة الفرعية (1) من الفقــرة 1 من الخطــابات المتبــادلة المذكــورة عـلي النحـو التـالي :

سيتم إلغاء عبارة مليار وتسعمائة وثــلاثة وثمانون مليون يــن يــابـاني (1.983.000.000 ين ياباني) واستبدالها بعبارة ملياران ومائة وثمانية مليون ين ياباني (2.108.000.000 ين ياباني).

وإنه ليشرفني أن اقترح أن يشكل هذا الخطاب وخطاب سعادتكم بالرد تأكيدًا للتفاهم المذكور أعلاه نيابة عن حكومة اليابان اتفاقًا بين الحكومتين يدخل حيز النفاذ من تاريخ تسلم حكومة اليابان للإخطار الكتابي من حكومة جمهورية مصر العربية الذي يفيد إتمام الإجراءات المحلية اللازمة لدخول هذا الاتفاق حيز النفاذ .

وإنه ليشرفني أن أؤكد نيابة عن حكومة اليابان التفاهم الوارد في خطاب سعادتكم وأوافق أن يشكل خطاب سعادتكم وهذا الخطاب بالـرد اتفاقـًا بين الحكومتين يدخل حيز النفاذ من تاريخ تسلم حكومة اليابان للإخطار الكتابي من حكومة جمهورية مصر العربية الذي يفيد إتمام الإجراءات المحلية اللازمة لدخول هذا الاتفاق حيز النفاذ .

حُرر هذا الخطاب باللغات اليابانية والعربية والإنجليزية ولكل منها ذات الحجية ، وعند أي اختلاف في التفسير يعتد بالنص المحرر باللغة الإنجليزية .
